These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Cinestyle Media ("Cinestyle," "we," "us," or "our") governing your access to and use of Cinestyle Studio software, related services, and digital products.
By downloading, installing, activating, or using Cinestyle Studio, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the software.
Subject to your compliance with these Terms and payment of applicable fees, Cinestyle Media grants you a limited, non-exclusive, non-transferable, revocable license to install and use Cinestyle Studio on devices you own or control for your personal or professional creative purposes.

Cinestyle Studio is currently available for Windows 10 and Windows 11 only. macOS and other platform versions are in development and are not guaranteed or scheduled. Platform availability may change without notice.
Cinestyle Studio is offered in the following subscription tiers. All prices are in US Dollars and are subject to change with 30 days notice to active subscribers.

Subscriptions are billed in advance on a monthly or annual basis. Annual subscriptions are billed as a single payment at the start of each subscription year. Monthly subscriptions are billed on the same date each month. Billing is processed through our payment processor and you authorize recurring charges until you cancel.
We reserve the right to adjust subscription pricing. Active subscribers will receive 30 days written notice via email before any price increase takes effect. You may cancel prior to the price change becoming effective. Continued use of the software after the effective date constitutes acceptance of the new pricing.
All prices are exclusive of applicable taxes. You are responsible for any sales tax, use tax, VAT, or similar taxes imposed by your local jurisdiction on your purchase.
Starter subscribers connect their own Anthropic API key to the application. All AI usage is billed directly by Anthropic to the subscriber's Anthropic account. Cinestyle Media has no visibility into, control over, or responsibility for your Anthropic API usage or billing. You are solely responsible for managing your Anthropic account and any costs incurred.
Writer, Pro, and Studio plan subscribers receive a monthly token allowance for AI features hosted by Cinestyle Media. Token allowances reset on the first day of each billing month and do not roll over.
When you approach your monthly token limit, Cinestyle Studio will display an in-app notification at 80% usage. If you exceed your monthly allowance, your options are:
We do not automatically charge overage fees without your explicit authorization. AI features will pause rather than generate surprise charges. You will never receive an unexpected bill for token overages.
Additional tokens can be purchased as one-time packs from the Cinestyle Vault. Top-up packs are consumed before your monthly allowance and expire at the end of your current subscription month if unused. Top-up packs are non-refundable.
Token usage is counted on output tokens (text generated by the AI). Input tokens (your prompts and context) are not counted against your monthly allowance. Token counts are logged in your account dashboard and updated in real time.
You may cancel your subscription at any time by logging into your account at studio.cinestylemedia.com or by emailing studio@cinestylemedia.com. Cancellations take effect at the end of your current billing period.
Cinestyle Studio is built on the principle that your work is always yours. Cancellation affects features, not your files or your writing tools.

Resubscribing at any time fully restores all features, databases, and cloud backup. Your projects and data are preserved during any lapse in subscription.
Monthly subscriptions: No refunds are issued for the current billing month. You may cancel at any time and retain access through the end of the month you have paid for.
Annual subscriptions: Refund requests submitted within 14 days of purchase are eligible for a full refund if the software has not been substantially used (fewer than 3 active sessions). After 14 days, annual subscriptions are non-refundable but remain active through the end of the subscription year.
One-time purchases (Add-ons, Token Packs, Vault products) are non-refundable once downloaded or activated.
We evaluate refund requests outside these guidelines on a case-by-case basis. Technical failures on our part that prevent you from using the software are grounds for pro-rated credit or refund at our discretion. Contact studio@cinestylemedia.com with any refund requests.
Cinestyle Studio offers optional add-on purchases that extend the functionality of the base application. Current and planned add-ons include:

Database add-ons (Literary Manager, Agent, and Production Company databases) are licensed — not sold — to you for your personal professional use. The following terms apply:
Add-on purchases are non-refundable once downloaded or activated. If a database add-on contains materially incorrect information or fails to function as described, contact us for a credit or replacement.
You own everything you write. All screenplays, scripts, novels, notes, project files, and creative content you create using Cinestyle Studio are your intellectual property. Cinestyle Media claims no ownership over your creative work.
Content generated by AI features within Cinestyle Studio — including character suggestions, loglines, scene descriptions, and formatted scripts — is generated in response to your prompts and direction. You are the creative director of that content. Cinestyle Media makes no claim to AI-assisted content generated within your sessions.
You are responsible for reviewing AI-generated content before use and ensuring it does not infringe on third-party intellectual property. Cinestyle Media is not liable for intellectual property claims arising from AI-generated content you choose to use.
Project files are stored locally on your device by default. Writer, Pro, and Studio subscribers with cloud backup enabled also have project data stored on Cinestyle Media servers. You can export all your data at any time regardless of subscription status.
On hosted plans, your prompts and AI responses pass through Cinestyle Media servers to reach the AI provider. We do not store the content of AI conversations beyond what is necessary for token accounting. We do not use your creative work to train AI models or for any purpose other than providing the service.
Starter subscribers using their own Anthropic API key connect directly to Anthropic's API. Their prompt data is governed by Anthropic's Privacy Policy, not ours. Cinestyle Media has no access to or visibility into those API calls.
Cinestyle Studio's AI features are powered by Anthropic's Claude API. Use of AI features is subject to Anthropic's Usage Policies. You agree to use AI features in compliance with those policies.
AI features are provided as creative tools and productivity aids. Cinestyle Media does not warrant that:
The Audio Table Read feature requires an ElevenLabs API key provided by you. ElevenLabs usage is governed by ElevenLabs' Terms of Service. Cinestyle Media is not responsible for ElevenLabs service availability or billing.
AI features depend on third-party API availability. Cinestyle Media is not liable for service interruptions caused by Anthropic, ElevenLabs, or other third-party providers. We will communicate known outages through our website and email where possible.
You agree to use Cinestyle Studio only for lawful purposes and in compliance with these Terms. You agree not to use the software to:
Violation of acceptable use policies may result in immediate suspension or termination of your account without refund.
Active subscribers receive software updates as they are released. Updates may add features, modify existing functionality, or remove features. We will communicate significant feature changes via email and in-app notifications. Updates are automatic when possible, or prompted for manual installation.
We reserve the right to modify, suspend, or discontinue any feature of Cinestyle Studio at any time. For features included in a paid tier, we will provide reasonable notice and, where possible, alternative functionality before removal. We will not materially reduce the core value of a subscription tier without notice and an opportunity to cancel.
Windows support is guaranteed for the current subscription period. We make no commitment regarding future platform availability or long-term support timelines beyond the current subscription year.
Cinestyle Studio is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the software will be error-free or uninterrupted.
To the maximum extent permitted by applicable law, Cinestyle Media's total liability to you for any claims arising from your use of Cinestyle Studio shall not exceed the total amount you paid for the software in the 12 months preceding the claim.
Cinestyle Media is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business, or loss of creative work, even if advised of the possibility of such damages.
We strongly recommend maintaining regular backups of your project files on local storage independent of Cinestyle Studio. Cinestyle Media is not liable for loss of creative work due to software failure, data corruption, or service interruption.
Cinestyle Media collects the following information in connection with your subscription:
We do not collect, store, or analyze the content of your creative work. Your screenplays, scripts, novels, and project files belong to you and remain on your device. We do not read your creative content, use it for training, or share it with third parties.
By creating an account, you agree to receive transactional emails (receipts, account notices, critical updates). You may opt out of promotional communications at any time. You cannot opt out of transactional emails while maintaining an active subscription.
We use the following third-party services: payment processing (Stripe or Lemon Squeezy), AI services (Anthropic), and email delivery (Mailchimp). Each provider's privacy policy governs their handling of data they receive.
These Terms are governed by the laws of the Commonwealth of Kentucky, United States of America, without regard to conflict of law principles.
We'd always prefer to resolve disputes directly. Before initiating any formal proceeding, please contact us at studio@cinestylemedia.com and give us a reasonable opportunity to address your concern. Most issues can be resolved within 5 business days.
For disputes that cannot be resolved informally, you and Cinestyle Media agree to attempt good-faith mediation before pursuing litigation. Mediation shall be conducted in Henderson, Kentucky or via video conference if mutually agreed.
You agree to resolve any disputes with Cinestyle Media on an individual basis and not as part of a class action, collective action, or representative proceeding.
We may update these Terms from time to time. We will notify active subscribers via email at least 14 days before material changes take effect. Continued use of the software after the effective date constitutes acceptance of the updated Terms. You may always cancel before accepting revised Terms.
